| 101-21 | 101 | 21 | CONVENTION FOR THE PROTECTION OF THE NATURAL RESOURCES AND ENVIRONMENT OF THE SOUTH PACIFIC REGION, WITH ANNEX, AND A PROTOCOL | Shipping and Marine Pollution | 1990-09-25T00:00:00Z | ENVIRONMENT, NATURAL RESOURCES, OCEAN DUMPING, POLLUTION, SOUTH PACIFIC, SOUTH PACIFIC REGION, 101-21, DUMPING | <!DOCTYPE html><html xmlns="http://www.w3.org/1999/xhtml" lang="en"><head><meta name="dc:title" content="[102] TreatyRes. 5 for Treaty Doc.101 - 21" /><meta name="Content-Encoding" content="ISO-8859-1" /><meta name="Content-Type" content="text/plain; charset=ISO-8859-1" /><title>[102] TreatyRes. 5 for Treaty Doc.101 - 21</title></head><body><p>TEXT OF RESOLUTION OF ADVICE AND CONSENT TO RATIFICATION AS REPORTED BY THE COMMITTEE ON FOREIGN RELATIONS AND APPROVED BY THE SENATE: Resolved, (two-thirds of the Senators present concurring therein), That the Senate advise and consent to the ratification of the Convention for the Protection of the Natural Resources and Environment of the South Pacific Region, with Annex, and the Protocol for the Prevention of Pollution of the South Pacific Region by Dumping, with Annexes, done at Noumea, New Caledonia, on November 24, 1986, subject to the following understandings: (1) In ratifying the Convention, the United States understands that wastes and other matter which would be recommended for exemption from regulatory control as radioactive waste by the relevant recommendations, standards, and guidelines of the International Atomic Energy Agency shall be treated as non-radioactive for the purposes of the Convention; and (2) It is the understanding of the United States that as the Convention does not apply to any warship, naval auxiliary, or other vessels or aircraft owned or operated by a state and used, for the time being, only on government non-commercial service and therefore entitled to sovereign immunity under international law, each state shall ensure, by the adoption of appropriate measures not impairing operations or operational capabilities of such vessels or aircraft owned or operated by it, that such vessels or aircraft act in a manner consistent, so far as is reasonable and practicable, with this Convention.</p></body></html> |
