(Currently, the maximum penalty is the domestic value of the merchandise.) It prohibits a person who commits a fraudulent violation from importing merchandise into the United States for a five-year period.Additionally, the bill increases the maximum civil penalty for a grossly negligent violation to the lesser of (1) 3 times the domestic value of the merchandise; or (2) 10 times the lawful duties, taxes, and fees. (Currently, the maximum penalty is the lesser of the domestic value of the merchandise or four times the lawful duties, taxes, and fees.) It prohibits a person who commits a grossly negligent violation from importing merchandise into the United States for a two-year period.Further, the bill applies these importation bans to an affiliated person (e.g., a family member or employee) of the person who committed the fraudulent or grossly negligent violation.The bill establishes a private right of action for an interested party (e.g., a manufacturer) affected by customs fraud or grossly negligent violations.The bill prohibits any person (or an affiliated person) who commits a fraudulent or grossly negligent violation from participating in the U.S. Customs and Border Protection's Importer of Record program, and further requires revocation of their importer of record numbers. 2026-02-27T15:56:53Z https://www.congress.gov/bill/119th-congress/senate-bill/3808

These export controls are implemented primarily under the Export Control Reform Act of 2018 (ECRA) through the Export Administration Regulations.Under the bill, BIS must establish a whistleblower incentive program to reward individuals who voluntarily report original information that results in BIS imposing fines under ECRA on persons that violate, attempt to violate, conspire to violate, or cause a violation of ECRA or any related regulation, order, license, or authorization.Additionally, BIS must establish a secure online portal for whistleblowers to report violations of ECRA. The bill outlines requirements for BIS to review, investigate, and provide status updates related to these reports.The bill authorizes BIS to pay an award to any whistleblower who voluntarily reported original information that led to the imposition of a fine under ECRA. Cassidy, Bill [R-LA] LA R C001075 1 Customs Facilitation Act of 2025This bill revises procedures for customs and trade enforcement and establishes related data and reporting requirements. Specifically, the bill provides statutory authority for the Border Interagency Executive Council to enhance coordination with border management authorities.The Department of Homeland Security must (1) ensure that a uniform automated platform provides a system to process and release cargo being imported into and exported from the United States, and (2) provide for the continuous modernization of the Automated Commercial Environment (the system through which the trade community reports imports and exports and the government determines admissibility).The bill allows for an accelerated payment of duty drawbacks (i.e., refunds on duties for imported items that are reexported or destroyed) for claims in which the claimant has submitted required documentation and obtained a properly executed bond.The Department of Commerce must issue regulations allowing for the submission of export manifest data prior to departure. Clerical errors in the submission of export data shall generally be exempt from penalties.The bill establishes requirements for specified agencies to follow when issuing regulations related to data collection for trade enforcement and facilitation.The Government Accountability Office must submit certain reports, including on the fee schedule of U.S. Customs and Border Protection (CBP). Additionally, among other actions, CBP must (1) notify members of the trade community when it makes changes to the minimum-security criteria for participation in the Customs Trade Partnership Against Terrorism program, and (2) review deadlines for CBP responses to requests. 2026-03-02T16:16:09Z https://www.congress.gov/bill/119th-congress/senate-bill/956

Additionally, the bill includes a group of 17 elements within the definition of REEs, including elements used in permanent magnets (e.g., dysprosium and neodymium).Specifically, the bill authorizes the President, acting through the Office of the U.S. Trade Representative, to (1) negotiate, enter into, and enforce a free trade agreement with a country or countries with respect to critical minerals and REEs when the President determines it is in the national interest; and (2) proclaim a modification or continuance of any existing duty, or continuance of existing duty-free or excise treatment, as the President determines necessary to carry out the agreement.
