Specifically, an athletic association, conference, or institution must permit a student athlete or a group of student athletes to market, or earn compensation for the value of, their NIL; and obtain or retain a certified agent for any matter or activity relating to such compensation. A third party may not use the NIL of a group to sell or promote any product or service without obtaining the written consent from each member of the group for that purpose. The Federal Trade Commission (FTC) must make available specified educational resources for student athletes with respect to financial and contract literacy and earning compensation for the commercial use of the student athlete's NIL. The bill sets forth prohibitions on activities of institutions, boosters, and third parties, including a prohibition on institutions, athletic associations, or conferences entering into NIL agreements with student athletes. The bill limits transfer penalties and prohibits incentives intended to induce the student athlete to enroll in, maintain enrollment in, or transfer to a particular institution. The FTC must establish an Office of Sport. Specifically, the ONDCP, in conjunction with USADA, must use all available tools to ensure that WADA maintains a proper conflict-of-interest policy and that independent athletes from the United States and other democratic countries, or representatives of such athletes, have voting positions on the Executive Committee and governing bodies of WADA; demonstrate leadership within the global community; have strict standards that work toward countering the state-sponsored doping system of the Russian Federation and other state-sponsored, systemic fraud through doping; and work collaboratively with democratic countries. Cantwell, Maria [D-WA] WA D C000127 3 Equal Pay for Team USA Act of 2022 This bill requires that all athletes representing the United States in international amateur athletic competitions receive equal compensation and benefits for their work, regardless of gender. Specifically, the bill requires, for a sport for which the U.S. Olympic and Paralympic Committees (the corporation) conduct separate programs for female and male athletes who represent the United States in international amateur athletic events, from funds directly provided by the corporation to the athlete (with exceptions), that there be equivalent and nondiscriminatory compensation, wages, benefits, medical care, travel arrangements, and payment or reimbursement for expenses. It shall be permissible to (1) consider merit, performance, seniority, or quantity of play in determining contract or other terms of participation; and (2) provide more beneficial terms of participation to athletes to address disparities in outside income, or the need to foster underdeveloped programs or address documented and justifiable personal need on the part of specific athletes or teams. The corporation must take all reasonable steps to advocate to international sports federations and other event organizers to equalize prizes, compensation, funding, and other support provided to athletes by such federations and organizers. The corporation must report to Congress at least annually on compliance. Each report must include detailed information on the median, minimum, and maximum stipends and bonuses provided to athletes, disaggregated by gender, race, and status of participation on a professional sports team. The source of funding for the grants shall be funds appropriated under enacted COVID-19 relief legislation that have not been obligated and are no longer being used to carry out activities authorized under those laws. Specifically, compensation for such an athlete may only be provided by unaffiliated third parties. Currently the National Collegiate Athletic Association and colleges generally prohibit student athletes from receiving compensation. A national amateur athletic association or institution of higher education may not punish an athlete in an amateur intercollegiate athletic event or competition based on the athlete having entered into an agency contract with an amateur athlete representative certified by the Amateur Intercollegiate Athletics Corporation (AIAC) established by this bill. An amateur intercollegiate athletics association shall allow an amateur intercollegiate athlete to transfer from one institution of higher education to another at least once without losing or delaying eligibility for intercollegiate athletics if specified conditions are met. The AIAC shall serve as a clearinghouse for best practices with respect to the rights and protections of amateur intercollegiate athletes who enter into agency and endorsement contracts. The bill requires institutions of higher education to provide a certain level of health care coverage for such athletes. Such institutions must make specified legally binding disclosures to each athlete before he or she commits to enroll in or attend the institution.
