[D-NJ] NJ D B001288 0 Industrial Agriculture Accountability Act of 2022 This bill establishes additional requirements for larger animal feeding operations (AFOs) owned or controlled by industrial operators and increases handling requirements for livestock and poultry. Specifically, the bill establishes the Office of High-Risk AFO Disaster Mitigation and Enforcement within the Department of Agriculture (USDA) and requires such industrial operators to register with the office and submit annual disaster mitigation plans (e.g., for public health emergencies and major disasters). In addition, industrial operators must pay annual disaster mitigation maintenance fees to the office and are liable for costs associated with disaster events or depopulation (the rapid destruction of animals in response to urgent circumstances). Industrial operators are restricted from using specified methods of depopulation; any person may sue an industrial operator or USDA over a violation. Further, USDA must establish depopulation standards that rapidly induce unconsciousness and death with minimal pain and distress. The Department of Labor must enforce minimum labor standards for industrial operators regarding covered workers or affected contract growers in disaster mitigation events, including whistleblower protections and health insurance requirements. Further, industrial operators may not use incarcerated workers in these events. The bill also includes provisions on the handling of livestock and poultry, such as requiring USDA to set additional standards for animal transport; including poultry in the Humane Methods of Slaughter Act of 1958 and creating a USDA grant program to transition processing facilities to a different slaughter method; requiring USDA to promulgate certain regulations regarding the humane treatment, euthanasia, and disposition of nonambulatory livestock; and terminating programs that allow for slaughter speeds that exceed existing limits or reduce the use of federal inspectors. 2023-08-18T11:30:28Z https://www.congress.gov/bill/117th-congress/senate-bill/5138

The bill specifies that state and federal grazing permit holders are eligible for the Emergency Conservation Program and the Emergency Forest Restoration Program. Further, emergency measures eligible for payments include new permanent measures, such as permanent water wells and pipelines. The bill also waives the 30-day comment period required for applications under the National Environmental Policy Act of 1969 for emergency measures carried out during a drought emergency. Modifications to the Livestock Forage Disaster Program allow for one monthly payment when a county has four consecutive weeks of a D2 rating (severe drought) and two payments for eight consecutive weeks of D2. Currently, one payment is available for eight consecutive weeks of D2. The bill expands coverage for honey bee producers under the Emergency Assistance for Livestock, Honey Bees, and Farm-Raised Fish Program (ELAP) for losses caused by adverse weather or drought, such as transportation costs and reduced honey crops. Further, the bill requires the ELAP payment rate for honey bee producers to incorporate additional factors, such as per-hive and per-colony rates of loss. The USDA must establish an interagency working group to improve the consistency and accuracy of U.S. Drought Monitor data. Under the bill, approved pricing mechanisms are generally purchases of fed cattle made through a negotiated purchase, through a negotiated grid purchase, at a stockyard, or through trading systems or platforms where multiple buyers and sellers can regularly make and accept bids and offers. The bill also establishes a maximum penalty for mandatory minimum violations by covered packers. USDA must provide technical assistance to help school food authorities and states meet nutritional standards and resume regular meal program operations for the 2023-2024 school year. The FDA must promulgate certain regulations relating to the use of the terms natural or healthy on food labels. The bill also imposes labeling requirements for certain foods that contain added coloring, added flavoring, phosphorus, caffeine, gluten, allulose, polydextrose, sugar alcohols, or isolated fibers. The FDA may, by regulation, deem a food ingredient to be a major food allergen. The FDA must also impose certain restrictions on the types of beverages that may be identified as infant formula or formula. The FDA must require food manufacturers to submit all information on the label of a food offered for sale in package form and update such submissions as necessary. USDA must (1) reevaluate and publish the market baskets of the plan by December 31, 2027, and every five years thereafter, based on current food prices, food composition data, consumption patterns, and dietary guidance; and (2) make adjustments to the plan to account for household size, changes in the cost of the diet, and the costs of food in specified areas. The bill modifies the requirements for calculating household income to determine SNAP eligibility by (1) authorizing a standard medical expense deduction for households containing an elderly or disabled member, and (2) eliminating the cap on the excess shelter expense deduction. The bill eliminates certain work requirements for SNAP. The requirements apply to able-bodied adults who are ages 18-49 and have no dependent children. The bill allows Puerto Rico, American Samoa, and the Northern Mariana Islands to participate in SNAP. In particular, the bill extends authority through September 30, 2022, for USDA to grant waivers related to summer food service programs; through June 30, 2022, for USDA to grant waivers of requirements to allow non-congregate feeding in the CACFP for purposes of providing meals and snacks with appropriate safety measures with respect to COVID-19; and through June 30, 2023, for USDA to grant waivers related to the nutritional content of meals served in child nutrition programs if it determines the waiver is necessary to provide meals and snacks, and there is a food supply chain disruption due to COVID-19. The bill authorizes USDA to establish a nationwide waiver of statutory and regulatory requirements under child nutrition programs for the 2022-2023 school year. Specifically, the Department of Agriculture (USDA) must collect and make publicly available (1) the race and gender of individuals who directly or indirectly received or applied for certain benefits, such as grants or other funding under USDA's commodity, conservation, research, extension, and education programs; and (2) the farm or ranch acreage of the recipients of such benefits. USDA must also collect and track the race and gender of individuals who register for the USDA service center information management system (a repository of participants in programs offered by USDA's Farm Service Agency, Natural Resource and Conservation Service, and rural development agencies). Additionally, the Commodity Credit Corporation must collect and disclose (1) the race and gender of individuals who receive or apply for benefits from the corporation, and (2) the farm or ranch acreage of the recipients of such benefits. The Federal Crop Insurance Corporation must collect and disclose (1) the name, race, gender, and farm or ranch acreage of individuals who receive federally subsidized insurance for crops, livestock, or forage; and (2) the premium subsidy amount for each recipient. The bill also requires financial institutions to gather demographic information in response to loan applications for farms and ranches that are minority-owned or women-owned. The bill also extends eligibility for free or reduced-price school lunches for children who were determined to be eligible in the school year prior to placement with a grandparent or relative for the school year immediately following placement. Specifically, the bill allows a producer that is prevented from planting its first crop to plant a second crop and receive an indemnity equal to the full guarantee for the first crop if the second crop (1) is an approved cover crop, and (2) cannot be harvested for grain or other uses unrelated to livestock forage or conservation. Under current law, if a producer plants a second crop it can only get an indemnity worth at most 35% of the prevented planting guarantee for the first crop. For a producer planting a cover crop following prevented planting, the Federal Crop Insurance Corporation (FCIC) may provide separate prevented planting coverage factors that include preplanting costs and the cost of cover crop seed. Expanded activities include efforts to improve soil health and preserve farmland and grassland.
