[R-ID] ID R R000584 0 Scotchman Peaks Wilderness Act of 2016 This bill designates approximately 13,961 acres of National Forest System land in Idaho, to be known as the Scotchman Peaks Wilderness, as wilderness and a component of the National Wilderness Preservation System. The wilderness area is withdrawn from specified public land, mining, mineral leasing, mineral materials, and geothermal leasing laws. The Department of Agriculture (USDA) may carry out management activities to maintain or restore fish and wildlife populations and habitats within the wilderness area if they would: promote healthy, viable, and more naturally distributed populations that would enhance wilderness values; and accomplish the purpose of the management activity with the minimum impact necessary. USDA may take measures within the wilderness area necessary for the control of fire, insects, and disease. Nothing in this bill creates a protective perimeter or buffer zone around the wilderness area. No national monuments may be designated by the President unless: each county, borough, parish, or equivalent unit of local government within and adjacent to the boundaries of which the proposed monument is to be located has been consulted respecting the designation and has approved it; and the governor and the legislature of each state within the boundaries of which such monument is to be located has approved it. Any national monument that is designated subject to such requirements shall be open to hunting, fishing, other forms of recreation, grazing, and historic or traditional uses, unless the Department of the Interior, the Department of Agriculture (USDA), or the Department of the Army closes all or a portion of the monument to one or more of such uses in accordance with the purposes of federal law relating to monuments, ruins, sites, and objects of antiquity. The foundation shall conduct and encourage programs and activities that support: educational, technical, scientific, and other assistance or activities to support the management of BLM lands with regard to wild free-roaming horses and burros, fish and wildlife and their habitats, National Conservation Lands, and recreation, cultural, and historic resources; and activities that support the reclamation and remediation of specified abandoned mine lands, specified orphaned oil and gas well sites, or public lands impacted by development connected to mineral exploration and development activities. Hoeven, John [R-ND] ND R H001061 1 This bill directs the Commissioner of Reclamation to: (1) provide to the holder of a permit for a cabin site located on federal property around the Dickinson Reservoir in North Dakota the first option to purchase the site for fair market value; and (2) convey to a permittee who exercises such option all U.S. interest in the site, easements for access to the site, a dock for the site, and the improvements on it. Beginning two years after enactment of this bill: (1) if a permittee has not exercised such option, the Commissioner shall transfer the site to Dickinson Parks & Recreation in Dickinson, North Dakota (the Department), without cost; and (2) the Commissioner shall transfer to the Department, without cost, land currently managed by the Department on which no cabin is located. Each such conveyance and transfer shall be made subject to specified mineral rights and rights-of-way of third parties. A permittee may not build any new permanent structure below an elevation of 2,430 feet. If a permittee builds such a structure, the permittee's site shall revert to the Department. Prescribed Burn Approval Act of 2016 (Sec. 3) This bill prohibits the Forest Service from authorizing a prescribed burn (i.e., a planned fire intentionally ignited) on Forest Service land if, for the county or contiguous county in which such land is located, the national fire danger rating system is indicating an extreme fire danger level. Nonetheless, the Forest Service may authorize a prescribed burn under such a condition if it coordinates with the applicable state government and local fire officials. Before carrying out a sale, Mohave County shall certify to Interior that qualified bidders have agreed to comply with: local zoning ordinances; and any master plan for the area approved by the county. Each sale of eligible land shall be: through a competitive bidding process, under which adjoining landowners are offered the first option, unless otherwise determined by Interior; for not less than fair market value, based on an appraisal; and conducted in accordance with the requirements regarding the administration of a sale of such land pursuant to this bill. The bill defines "eligible areas" as lands within the outer boundaries of units or components of the National Park, National Wilderness Preservation, National Wildlife Refuge, or National Landscape Conservation Systems, areas identified by the Bureau of Land Management (BLM) of the Department of the Interior as having wilderness characteristics, certain designated lands within the National Forest System or administered by the BLM, and sentinel landscapes designated by the Department of Agriculture, Department of Defense, or Interior. Interior shall create a process for the relinquishment of such parcels. A western state may select, and Interior may convey, lands that are mineral in character. The overall value of the state land grant parcels and the public land to be conveyed shall be equal. Klobuchar, Amy [D-MN] MN D K000367 1 Environmental and Economic Benefits Restoration Act of 2016 This bill amends the Cooperative Forestry Assistance Act of 1978 to direct the Department of Agriculture (USDA) to establish a landscape-scale restoration program to provide financial and technical assistance for landscape-scale restoration projects on state, political subdivision, and private forest lands that maintain or improve benefits from trees and forests on such lands. The program shall: address the national private forest conservation priorities specified under the Act; and enhance public benefits from trees and forests, as identified in a state-wide assessment and a long-term state-wide forest resource strategy under the Act. The program shall also have one or more objectives, including to: protect or improve water quality or quantity; reduce wildfire risk; protect or enhance wildlife habitat, consistent with wildlife objectives established by the applicable state fish and wildlife agency; improve forest health, including addressing native, nonnative, and invasive pests; or enhance opportunities for new and existing markets in which the production and use of wood products strengthens local and regional economies. USDA shall establish a measurement system to measure the results of landscape-scale restoration projects assisted under this bill. USDA shall allocate from the amounts made available under this bill: 50% for the competitive process for distributing funds for landscape-scale restoration projects; and 50% proportionally to states to maximize the achievement of the restoration program's objectives and to address the highest national priorities, as identified in state-wide assessments and long-term state-wide forest resource strategies. The nonfederal lands acquired by USDA shall be added to and administered as part of the forest. The values of the federal and nonfederal lands to be exchanged shall be equal. Interior and Alaska shall select an appraiser to conduct appraisals of the federal and nonfederal lands in accordance with nationally recognized appraisal standards. The bill requires the route of the road corridor to follow a specified southern road alignment. Any grants issued by the GOMA for ecosystem research can be used to: monitor and develop strategies that address water quality needs, investigate the effects of natural and human-induced changes, restore and sustain living coastal and marine resources, restore and conserve key habitats, or eliminate contamination problems. In addition, the GOMA is required to submit to NOAA an annual report that describes the goals, objectives, and benefits of any efforts undertaken to strengthen cooperation among participants in restoring and protecting the Gulf of Mexico ecosystem. During the 30-day period beginning when the draft is completed, there shall be an opportunity for public comment on the draft, including an opportunity for the Utah Test and Training Range Community Resource Advisory Group established by this bill to comment on it. The memorandum of agreement shall allow Interior to continue management of the BLM land in accordance with the Federal Land Policy and Management Act of 1976 and applicable land use plans, while allowing for temporary closure of such land. Interior and the Air Force shall establish within the memorandum of agreement a framework for resolving any disagreement over the issuance of permits or rights-of-way on the BLM land. The bill states that the memorandum of agreement shall be for a term to be determined by Interior and the Air Force, not exceeding 25 years. Production of all locatable minerals from any mining claim shall be subject to a reasonable royalty established by Interior of between 2% and 5% of the gross income from mining for production of all locatable minerals, which may be reduced in certain circumstances. Interior shall establish a comprehensive inspection, collection, fiscal, and production accounting and auditing system The bill prescribes requirements for exploration permits and mining permits. Any mining operator shall provide Interior with specified financial assurances to ensure the completion of reclamation and the restoration of any land or water adversely affected by the mineral activities. The bill eliminates the fiscal year limitation on funding for the Payments in Lieu of Taxes Program. This Program compensates local governments for tax revenue lost due to tax-exempt federal lands within their boundaries. The bill amends the Land and Water Conservation Fund Act to make permanent the authorization for the Land and and Water Conservation Fund. Amounts in such Funds remain available for expenditure to carry out such Act without further appropriation or fiscal year limitation. The nonexclusive perpetual access easement granted to BHI shall allow: (1) BHI to fully maintain, at its own expense, and use Forest Service Road 371 from its junction with Forest Service Road 368 in accordance with historic BHI use and maintenance patterns; and (2) full and continued public and administrative access and use of FSR 371 in accordance with the existing Forest Service travel management plan, or as it may be revised by USDA. (Sec. 5) The USDA shall determine the values of the lands to be exchanged through appraisals following specified requirements. The values shall be equal, or if they are not equal, equalized as prescribed by this Act. The appraised value of the federal land parcel shall not reflect any increase or diminution in value due to the existing special use permit to BHI on the parcel and its improvements. The Barr Trail easement donation shall not be appraised for purposes of this Act. (Sec. 6) The lands acquired by the USDA under this Act shall, without further USDA action, be permanently withdrawn from all forms of appropriation and disposal under the public land laws (including the mining and mineral leasing laws) and the Geothermal Steam Act of 1930, except to the extent necessary to permit the disposal of the federal land parcel to BHI.
