(LD50 is a procedure whereby toxicity is measured in terms of the median dose that will kill 50 percent of the test animals within a specified time.) Prohibits Federal department or agency heads from considering LD50 test results when determining product safety, labeling, or transportation requirements for purposes of Federal regulation. Requires Federal department and agency heads to: (1) review and evaluate directives that call for the use of an animal toxicity test; and (2) promulgate regulations specifying the use of nonanimal alternatives. Permits the use of animal toxicity tests under certain conditions. Sets forth requirements which supersede such provisions during the interim period (from the enactment of this Act until October 1, 1993). Makes such exemptions available only to owners of vessels which: (1) are vessels of the United States; and (2) have valid fishing permits issued by the Secretary of Commerce (the Secretary) under the Magnuson Fishery Conservation and Management Act. Declares the immediate goal that the incidental kill or serious injury of marine mammals permitted in the course of commercial fishing operations be reduced to insignificant levels approaching a zero mortality and serious injury rate. Sets forth procedures to be used during such interim period for identifying categories of fisheries and registering vessels and vessel owners in order to comply with the Act. Directs the Secretary to compile and publish lists of fisheries in three categories based on frequency of incidental taking of marine mammals by vessels in those fisheries. Requires proposed lists within 60 days after enactment of this Act, final lists within 120 days after enactment, and at least annual updating and revising of such lists based on specified information-gathering programs, other relevant sources, and public comment. Directs the Secretary to grant an exemption for a vessel engaged in a fishery identified under either of the two categories of frequent or incidental taking of marine mammals, upon the receipt of a completed registration form. Requires a copy of the completed report to be submitted to specified congressional committees within 180 days after enactment of this Act, to initiate a dialogue with the Truckee-Carson Irrigation District, the Fallon Paiute-Shoshone Indian Tribe, the State of Nevada, interested local governments within the Carson and Truckee River basins, and the Lahontan Valley Wetlands Coalition to: (1) develop a draft long term plan to maintain a specified average acreage of high quality wetland habitat in the Lahontan Valley; and (2) enhance wildlife habitat comprising the Stillwater component of the Western Hemisphere Shorebird Reserve Network. Directs the Secretary: (1) within one year after enactment of this Act, to conduct public meetings in Reno, Fallon, and Carson City, Nevada, to seek comment on such draft plan; and (2) within 90 days after the last of such meetings, publish a final plan, and make recommendations to the Congress on any new authority or appropriations that may be necessary to fully implement the plan. Directs the Secretary to consider possible cost-sharing arrangements involving a mix of Federal, State, and private funds, in identifying funding mechanisms to implement the plan. [D-KY] KY D F000268 3 Pet Theft Act of 1988 - Amends the Federal Laboratory Animal Welfare Act (the Act) to prohibit, except in instances where State or local law supersedes, class B licensees (dealers) from obtaining live random source dogs and cats from: (1) a source other than a State, county, or city owned and operated pound; (2) a private entity established for the purpose of caring for animals (such as a humane society or any other organization that is under contract with a State, county, or city that operates as a pound or shelter, and that releases animals on a voluntary basis); (3) research facilities licensed by the Department of Agriculture; or (4) individuals who have bred and raised such dogs and cats on their own premises. Requires such pounds, shelters, or organizations to hold and care for dogs or cats for at least seven days before selling them to dealers (thus enabling them to be recovered by their original owners or adopted by other individuals). Prohibits dealers from selling, providing, or making available to any individual or entity a random source dog or cat without providing the recipient with a valid certification. Sets forth certification requirements. Requires the original certification to accompany the shipment of the dog or cat to the recipient, and a copy to be retained by the dealer. Requires the recipients and dealers to retain such certificates or copies for at least one year for enforcement purposes. Requires a copy of the certificate to accompany any transfer of an animal from one research facility to another. Subjects dealers who fail to act according to the requirements of this Act, or who include false information in the certification, to: (1) specified penalties under the Act; (2) a fine of $5,000 per dog or cat for subsequent violations; and (3) permanent revocation of their license for violating such requirements three or more times.
