Under current law, some remedial actions result in hazardous substances remaining at the site, so there must be a review every five years to assure that human health and the environment are being protected. Specifically, the bill sets a schedule for increasing the percentage of zero-emission vehicles a vehicle manufacturer delivers for sale, culminating in a requirement to sell only zero-emission vehicles from 2035 on. The bill also requires the EPA to establish a zero-emission vehicle credit program that approves one zero-emission vehicle credit for each zero-emission vehicle delivered for sale in the United States and partial credits for qualified electric vehicles based on the estimated proportion of the mileage driven on the battery. Manufacturers that fail to meet the minimum required percentage of zero-emission vehicle sales must submit to the EPA a quantity of zero-emission vehicle credits sufficient to offset the excess. Credits may also be sold, transferred, exchanged, or retired in certain circumstances. The bill imposes civil penalties for the failure to comply with zero-emission vehicle credit standards, with collected penalties being deposited into the Highway Trust Fund. Currently, regulations require a farm to have an oil spill control and prevention plan that is certified by a professional engineer if the farm's aboveground oil storage capacity is above a certain threshold or if the farm has a reportable oil discharge history. A farm with lower aboveground storage capacity and no reportable history is either allowed to self-certify its plan or not required to have a plan at all, depending on the farm's storage capacity.     Under the bill, the Environmental Protection Agency must require a farm to have a professionally certified plan if the farm has an aggregate aboveground oil storage capacity of 40,000 gallons or more, whereas the current threshold is 20,000 gallons. The bill also raises the aggregate capacity thresholds at which a farm with no reportable oil discharge history may self-certify its plan or is not required to have a plan. [D-NM-1] NM D H001080 3 Environmental Justice Legacy Pollution Cleanup Act of 2020 This bill provides for funding and permitting restrictions in relation to environmental cleanup and remediation of areas with public health threats. Specifically, the bill provides supplemental appropriations for FY2020 to the Department of the Interior, the Environmental Protection Agency (EPA), the Department of Housing and Urban Development (HUD), the Army Corps of Engineers, the Department of Agriculture, and the Indian Health Service for various environmental cleanup and remediation projects, including those that affect low-income and tribal communities. For example, the bill appropriates $30 billion to HUD to provide grants to local governments to evaluate and reduce lead-based paint hazards and other housing-related health and safety hazards in low-income housing. The bill immediately prohibits the granting of a Title V permit for a major proposed source (relating to air pollution control requirements) for an overburdened census tract, which is an area that has been identified as having a specified amount of particulate matter and an identified heightened risk of cancer due to air pollution. The EPA must publish a list of overburdened census tracts and update the list annually based on the most recently available modeling and monitoring data. Energy critical materials means chemicals that have a high risk of a supply disruption and are critical to one or more energy-related technologies; a substantial supply disruption of such material would significantly inhibit large-scale deployment of technologies that produce, transmit, store, or conserve energy. The analysis must determine the impacts of such legislation, regulation, or investments on frontline communities (e.g., communities that have experienced environmental injustice or are vulnerable to climate injustice). Specifically, the bill establishes a Climate and Environmental Equity Office within the Congressional Budget Office. The former must prepare an analysis for each bill or resolution with an environmental or climate change nexus that is reported by any congressional committee. The analysis must include the bill's impacts on frontline communities. The bill also establishes an Office of Climate and Environmental Justice Accountability within the Office of Management and Budget. Among other things, the former must (1) measure the costs of environmental and climate regulations on frontline communities, (2) review agencies' investments to determine if they have an environmental or climate change nexus and ensure that frontline communities benefit from such investments, and (3) represent the views of frontline communities in the rulemaking process. Each agency must biannually publish a climate and environmental justice accountability agenda. An agency must prepare and publish a climate and environmental justice analysis for a proposed or final rule that may have a significant impact on a substantial number of residents within frontline communities. Blunt Rochester, Lisa [D-DE-At Large] DE D B001303 7 Public Health Air Quality Act of 2020 This bill requires the Environmental Protection Agency (EPA) to implement policies, programs, and regulations related to air quality monitoring. Specifically, the EPA must implement a program using specified methods and technologies to administer or conduct the best available form of fenceline monitoring (i.e., monitoring of ambient air concentration using technology at a site's property line) of specified stationary sources of hazardous air pollutants. The stationary sources to be monitored must include the 25 high-priority facilities named in the EPA Inspector General report (#20-N-0128) from March 31, 2020, and at least another 25 major sources or synthetic area sources. Among other requirements, the EPA must also determine whether whether to add fenceline monitoring for any additional stationary sources, complete an evaluation and promulgate a determination on whether any existing emission factors must be updated to better reflect or account for the results of fenceline monitoring data collected under the established program, promulgate regulations establishing emission standards for specified source categories, require an additional 80 National Core multi-pollutant monitoring stations, and deploy at least 1,000 air quality sensors to monitor specified pollutants in census tracts or counties with per capita death rates from COVID-19 (i.e., coronavirus disease 2019) that are at least 10% higher than the national average. For certain conditions associated with exposure to PFAS, the bill provides eligibility for Department of Veterans Affairs (VA) hospital care and medical services to veterans who served on active duty at military installations at which individuals were exposed to PFAS. Service by veterans as reservists or civilian firefighters shall be considered active duty service for eligibility purposes if such service occurred during a period specified by the VA on the applicable military installations. The bill also provides eligibility for VA hospital care and medical services for exposure-related conditions to the family members of such veterans and civilian firefighters. The bill establishes a presumption of service-connection for specified illnesses or diseases related to PFAS exposure that manifest in veterans (including reservists or veterans serving as civilian firefighters) who served on active duty at a military installation where they were exposed to PFAS. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Each administration must report each year on (1) all estimated costs and factors affecting total power costs, including estimates of its total compliance costs; and (2) sources of replacement power. The bill prohibits Interior from designating critical habitat for endangered or threatened species in certain water storage, diversion, or delivery facilities. In addition, the bill exempts projects to install or maintain electrical transmission poles or power lines from environmental review requirements.
