[D-CA-52] CA D P000608 3 Utilizing Significant Emissions with Innovative Technologies Act or the USE IT Act This bill amends the Clean Air Act to require the Environmental Protection Agency (EPA) to establish: (1) a competitive prize program for certain technology projects that capture carbon dioxide directly from the air, and (2) a Direct Air Capture Technology Advisory Board to advise the EPA on carrying out the program. The EPA must: (1) carry out a research and development program for carbon dioxide utilization to promote technologies that transform carbon dioxide generated by industrial processes into a product of commercial value, and (2) support activities relating to carbon dioxide utilization by providing technical and financial assistance. The bill amends the Fixing America's Surface Transportation Act to apply the Act's accelerated environmental review and permitting procedures to the construction of infrastructure that captures, utilizes, or sequesters carbon dioxide and the construction of carbon dioxide pipelines. The Council on Environmental Quality (CEQ) must publish guidance to: (1) facilitate reviews associated with the deployment of carbon capture, utilization, and sequestration projects and carbon dioxide pipelines; and (2) support the efficient, orderly, and responsible development of such projects and pipelines. Gibbs, Bob [R-OH-7] OH R G000563 6 Water Infrastructure Improvement Act (Sec. 3) This bill amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to allow municipalities to develop a plan that integrates wastewater and stormwater management. A permit for a municipal discharge under the national pollutant discharge elimination system that incorporates an integrated plan may integrate all requirements under the Act addressed in the plan, such as requirements relating to combined sewer overflows, sanitary sewer collection systems, and total maximum daily loads. A plan that is incorporated into a permit may include the implementation of green infrastructure and projects to reclaim, recycle, or reuse water. Green infrastructure includes measures that mimic natural processes to store, reuse, or reduce stormwater. Those permits may include a schedule of compliance that allows actions for meeting water quality-based effluent limitations to be implemented over more than one permit term if the compliance schedules are authorized by state water quality standards. A municipality under an administrative order or settlement agreement may request a modification of the order or settlement based on the municipality's integrated plan. The EPA must report on each integrated plan developed and implemented through a permit, order, or judicial consent decree since June 5, 2012, including a description of the control measures, levels of control, estimated costs, and compliance schedules for the requirements implemented through such a plan. (Sec. 4) The bill establishes an Office of the Municipal Ombudsman in the Environmental Protection Agency (EPA) to provide: (1) technical assistance to municipalities seeking to comply with the Clean Water Act, and (2) information to the EPA to ensure that agency policies are implemented by all EPA offices. Specifically, the bill requires the Environmental Protection Agency (EPA) to publish an updated National Air Toxics Assessment once every two years. The assessment uses emissions data to estimate health risks from toxic air pollutants. The bill also requires the EPA to use data from its Integrated Risk Information System when conducting rulemaking with respect to chemicals that have been assessed in the system. For chemicals that are found to pose an adverse health risk, the EPA shall identify and do additional review on facilities that are significant sources of the chemical to determine whether the facility poses an adverse public health risk. Under the bill, chemicals identified as carcinogenic in the system must have a toxic chemical release form completed by the owner or operator of a facility. The bill requires the Department of Health and Human Services (HHS) to consult with appropriate EPA offices regarding the future schedule of assessments of chemicals to be conducted under the system, the results or existing assessments, and concerns that may merit additional review. HHS must also administer personal exposure tests for chemicals that pose a new adverse public health risk to vulnerable populations, such as children. One of the centers must be the national electronic clearinghouse center and operate a website and a public database on the infrastructure. In addition, the EPA must provide grants to state, tribal, or local governments or entities that manage stormwater, drinking water resources, or wastewater resources for innovative stormwater control infrastructure projects. The EPA must ensure that: (1) EPA's Office of Water, Office of Enforcement and Compliance, Office of Research and Development, and Office of Policy promote the use of the infrastructure in, and coordinate the integration of, permitting programs, planning efforts, research, technical assistance, and funding guidance; and (2) the Office of Water supports establishing innovative financing mechanisms in the implementation of the infrastructure. The EPA must: (1) direct each EPA regional office to promote and integrate the use of the infrastructure within the region, and (2) promote sharing information about the infrastructure approaches. The bill repeals: (1) requirements for regulations on variance technologies, and (2) state authority to exempt small public water systems from national primary drinking water regulations if the system installs certain treatment techniques. The Environmental Protection Agency must: prescribe follow up inspections after violations by public water systems, establish requirements for electronic submission of compliance monitoring data by public water systems, study the presence of pharmaceuticals and personal care products in drinking water sources, collect data on best practices for administration of SRF programs, implement a voluntary certification program for effective water loss and leak control technology, and submit a strategic plan for assessing and managing the risks of drought to drinking water provided by public water systems. The departments: (1) may provide conservation grants to promote the voluntary conservation of endangered species and threatened species by property owners, (2) must provide financial aid to alleviate the costs of complying with the Act, and (3) may provide technical assistance when requested to enhance the conservation effects of the grants or aid. Under candidate conservation agreements and safe harbor agreements, property owners enter into agreements with the Department of the Interior or the Department of Commerce, as appropriate, to address the needs of endangered, threatened, or candidate species in exchange for assurances regarding resource use restrictions that might be imposed if circumstances change. Each incidental take permit, candidate conservation agreement, and safe harbor agreement must contain certain assurances governing permit revocation, changed circumstances, and unforeseen circumstances as prescribed by the bill. This bill amends the Great Ape Conservation Act of 2000, including to authorize the Department of the Interior to award a multi-year grant for carrying out a project that is an effective, long-term conservation strategy for great apes (defined in the Act as chimpanzees, gorillas, bonobos, orangutans, and gibbons) and their habitats. This bill amends the Marine Turtle Conservation Act of 2004 to expand eligibility for financial assistance to include: (1) a wildlife management authority of a U.S. territory, and (2) projects for the conservation of freshwater turtles and tortoises. The U.S. Fish and Wildlife Service must establish Theodore Roosevelt Genius Prizes for: (1) prevention of wildlife poaching and trafficking, (2) promotion of wildlife conservation, (3) management of invasive species, (4) protection of endangered species, and (5) nonlethal management of human-wildlife conflicts. Beginning in 2019, crude oil refineries, petroleum importers, coal mines, coal importers, and natural gas suppliers or processors must purchase carbon permits equivalent to the amount of CO2 that would be emitted by covered fuels. Treasury will auction these permits to those entities. This bill establishes a declining cap on the quantity of permits issued to reduce CO2 emissions until 2050 when the permits issued represent an amount 80% below 2005 CO2 emission levels. Treasury must issue permits for carbon capture and sequestration of CO2 from covered fuels. This bill provides for the trading or sale of permits between entities, the banking by entities of permits for future years, and the borrowing by Treasury of permits from future years to stabilize permit prices. Auction proceeds and penalties are returned to U.S. citizens lawfully present in the United States using the Healthy Climate Trust Fund established by this bill. Treasury must impose fees on the import and pay fees for the export of carbon-intensive goods when the export country does not have equivalent measures to regulate greenhouse gases. Carbon-intensive goods are goods with an increased cost due to the regulation of greenhouse gases. The Environmental Protection Agency must regulate within 10 years all sources of greenhouse gases that are anthropogenically emitted. (Hypoxia is a deficiency of oxygen.) The task force must include a representative from the U.S. Army Corps of Engineers. Each required scientific assessment of harmful algal blooms in coastal waters must examine freshwater harmful algal blooms that originate in freshwater lakes or rivers and migrate to coastal waters. In administering the program, the National Oceanic and Atmospheric Administration (NOAA) must provide: (1) grants for accelerating the utilization of effective methods of intervention and mitigation to reduce the frequency, severity, and impacts of harmful algal bloom and hypoxia events; and (2) technical assistance to regional state, tribal, and local governments with respect to harmful algal blooms and hypoxia events. NOAA must use cost effective methods in carrying out the Act and develop contingency plans for the long-term monitoring of hypoxia. The bill amends the Clean Air Act to require the EPA to address potential cumulative impacts of a major stationary source of air pollutants when issuing or renewing permits for those sources. The bill states that the authorization to bring citizen suits under certain environmental laws does not preclude the right of an individual to bring a civil action for deprivation of implied rights under those laws or common law. One of the centers must be the national electronic clearinghouse center and operate a website and a public database on the infrastructure. In addition, the EPA must provide grants to state, tribal, or local governments or entities that manage stormwater, drinking water resources, or wastewater resources for innovative stormwater control infrastructure projects. The EPA must ensure that: (1) EPA's Office of Water, Office of Enforcement and Compliance, Office of Research and Development, and Office of Policy promote the use of the infrastructure in, and coordinate the integration of, permitting programs, planning efforts, research, technical assistance, and funding guidance; and (2) the Office of Water supports establishing innovative financing mechanisms in the implementation of the infrastructure. The EPA must: (1) direct each EPA regional office to promote and integrate the use of the infrastructure within the region, and (2) promote sharing information about the infrastructure approaches. Using the systems of the International Boundary and Water Commission, United States and Mexico, the Department of State must establish the Transboundary Waterway Alert System, an updated and online system to protect U.S. citizens from undue and avoidable harm from wastewater, sewage, trash, and sediment spills and flooding for each major waterway along the U.S.-Mexico border. The program encourages the reduction in the speed of certain vessels transiting the Greater Santa Barbara Channel Region in California in order to reduce air pollution, harmful underwater acoustic impacts, and the risk of fatal whale strikes. The program must be modeled after the pilot Vessel Speed Reduction Program, except financial incentives for participation in the program may not be provided. The program must require, at a minimum, that each vessel of the awardee transit that region at speeds of 12 knots or lower. In addition, the program must require vessels to participate in the Port of Los Angeles or Port of Long Beach vessel speed reduction programs if the vessels call at those ports. The Office must create an official seal to be recognized as the symbol of excellence in compliance with the program. The President must establish the Interagency Working Group on Environmental Justice Compliance and Enforcement. The bill specifies the duties of the working group, including: (1) advising and assisting federal agencies in identifying and addressing the disproportionate human health and environmental effects of federal programs, policies, practices, and activities on communities of color, low-income communities, rural communities, and tribal and indigenous communities; (2) developing and publishing a guidance document that defines terminology used in dealing with environmental justice issues; and (3) developing a coordinated interagency federal environmental justice strategy. The Environmental Protection Agency (EPA) must: (1) offer environmental justice training to federal employees, (2) establish grant programs that address environmental justice, (3) establish a partnership-based training program to increase the capacity of residents of environmental justice communities to identify and address disproportionately high and adverse human health or environmental effects, and (4) establish the Environmental Justice Clearinghouse. The bill expands risk assessment requirements for community water systems to include risks from natural hazards. The bill creates a grant program within the EPA called the Drinking Water Infrastructure Risk and Resilience Program. The bill: (1) reauthorizes through FY2022 the public water system supervision grant program and the source water petition program, and (2) reauthorizes through FY2022 and revises the drinking water state revolving fund. The bill expands requirements for public water systems to monitor unregulated containments. The EPA must establish a grant program for the replacement of drinking water fountains that contain lead in schools and day care facilities.
