E8-30677 Proposed Consent Decree, Clean Air Act Citizen Suit Notice In accordance with section 113(g) of the Clean Air Act, as amended ("Act"), 42 U.S.C. 7413(g), notice is hereby given of a proposed consent decree to address a lawsuit filed by Rocky Mountain Clean Air Action and WildEarth Guardians (collectively "Plaintiffs") in the United States District Court for the District of Columbia: Rocky Mountain Clean Air Action, et al. v. Johnson, No. 08-1422 (D. D.C.). Plaintiffs filed a deadline suit to compel the Administrator to respond to an administrative petition seeking EPA's objection to a CAA Title V operating permit issued by the Colorado Department of Public Health and Environment, Air Pollution Control Division to the CEMEX, Inc. cement plant near Lyons, Colorado ("CEMEX").
