| 96-32236 | Hazardous Air Pollutants: Regulations Governing Constructed or Reconstructed Major Sources | Rule | The EPA is promulgating regulations implementing certain provisions in section 112(g) of the Clean Air Act as amended in 1990 (1990 Amendments). Section 112(g) applies to the owner or operator of a constructed, reconstructed, or modified major source of hazardous air pollutants (HAP). After the effective date of this rule, all owners or operators of major sources that are constructed or reconstructed will be required to install maximum achievable control technology (MACT) (unless specifically exempted), provided they are located in a State with an approved title V permit program. This rule establishes requirements and procedures for the owners or operators to follow to comply with section 112(g). This rule also contains guidance for permitting authorities in implementing section 112(g). When no applicable Federal emission limitation has been promulgated, the Clean Air Act (Act) requires the permitting authority (generally a State or local agency responsible for the program) to determine a MACT emission limitation on a case-by-case basis. This rule assures that effective pollution controls will be required for new major sources of air toxics during the period before EPA can establish a national MACT standard for a particular industry. This rule establishes procedures for making such determinations.
