The Report to Congress contains a detailed study of cement kiln dust (CKD), which is within the scope of the exemption from hazardous waste regulations provided by section 3001(b)(3)(A)(iii) of RCRA as codified at 40 CFR 261.4(b)(8); this exemption is often referred to as the Bevill Exemption. The report also presents the Agency's decision making rationale and a series of options being considered regarding regulatory options for cement kiln dust waste.
