| 2015-28649 | Notice of Opportunity To Provide Information on Existing Programs That Protect Water Quality From Forest Road Discharges | Notice | The Environmental Protection Agency (EPA) solicits public input and information on existing public and private sector programs that address stormwater discharges from forest roads. This information will assist EPA in responding to the remand in Environmental Defense Center, Inc. v. U.S. EPA, 344 F.2d 832 (9th Cir. 2003) that requires EPA to consider whether the Clean Water Act requires the Agency to regulate forest roads. This notice does not imply that EPA has made any decision to do so. EPA is considering the implementation, effectiveness, and scope of existing programs in addressing water quality impacts attributable to stormwater discharges from forest roads prior to making any decision. The Agency plans to assess a variety of existing programs, including federal, state, local, tribal, third party certifications, and combinations of these approaches, as well as voluntary best management practices (BMP)-based approaches.
