2014-03976 Irradiation in the Production, Processing, and Handling of Food Rule The Food and Drug Administration (FDA or we) is responding to objections and is denying requests that it received for a hearing on the final rule that appeared in the Federal Register of August 22, 2008 (73 FR 49593), and that amended the food additive regulations to provide for the safe use of ionizing radiation for control of food- borne pathogens and extension of shelf life in fresh iceberg lettuce and fresh spinach. After reviewing objections to the final rule and requests for a hearing, we have concluded that the objections do not raise issues of material fact that justify a hearing or otherwise provide a basis for revoking or modifying the amendment to the regulation. We are denying the request for a stay of the effective date of the amendment to the food additive regulations.
