2011-15399 Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To List the Utah Population of the Gila Monster as an Endangered or a Threatened Distinct Population Segment Proposed Rule We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list the Utah population of the Gila monster (Heloderma suspectum) as an endangered or a threatened distinct population segment (DPS) under the Endangered Species Act of 1973, as amended (Act), and to designate critical habitat. Based on our review, we find that the petition does not present substantial information indicating that listing the Utah population of the Gila monster may be warranted, because the population does not constitute a DPS, and is therefore not a listable entity under the Act. Therefore, we are not initiating a status review in response to this petition.
