On February 17, 2010, Plaintiff filed an amended complaint alleging that EPA failed to perform nondiscretionary duties under the Clean Air Act related to the attainment of National Ambient Air Quality Standards (NAAQS) for ozone in the Baton Rouge area. Specifically, they alleged that EPA failed to promulgate a Federal Implementation Plan to adopt regulations for the Baton Rouge area necessary to implement CAA requirements for ozone nonattainment areas that have been designated as "severe" nonattainment areas for the 1-hour ozone standard.
