| 05-3366 | Prevention of Significant Deterioration for Nitrogen Oxides | Proposed Rule | To preserve the air quality in national parks and other areas that are meeting the national ambient air quality standards (NAAQS) for nitrogen dioxide (NO<INF>2</INF>), EPA is reevaluating the increments for NO<INF>2</INF> that were first established in 1988 under its program to prevent significant deterioration of air quality (PSD program). The EPA is initiating this rulemaking action to comply with a 1990 court ruling that directed the Agency to consider and harmonize the statutory criteria for establishing PSD regulations for nitrogen oxides (NO<INF>X</INF>) contained in sections 166(c) and 166(d) of the Clean Air Act (CAA or Act). After an initial reevaluation of the existing NO<INF>2</INF> increments under these statutory criteria, EPA is proposing three options. One proposed option is not to change the existing increments. We are also proposing two other options that would allow States to use alternative approaches in lieu of the existing increments for NO<INF>2</INF> to satisfy the statutory criteria for preventing significant deterioration of air quality due to emissions of NO<INF>X</INF>.
