CMS-2008-0038 CMS Multiple Source Drugs Definition Rulemaking 2021-04-21T01:00:27Z 0b000064804abee0 0938-AP26 This final rule revises the definition of “multiple source drug” as published in the “Medicaid Program; Prescription Drugs” CMS-2238-FC on July 17, 2007. We must publish this interim final rule timely in accordance with Civil Action No. 1:07cv02017, in the United States District Court for the District of Columbia, wherein, the Court found that, in creating the Average Manufacturer Price (AMP) rule, the Secretary did not comply with the statutory definition of “multiple source drug.” This Court Order enjoins the AMP rule, and thus, prevents us from implementing the provisions of the rule which affect Medicaid reimbursement rates for retail pharmacies; including the posting of AMP data on a public web site and the issuance of the Deficit Reduction Act of 2005 AMP based Federal upper limits.
This final rule revises the definition of “multiple source drug” as published in the “Medicaid Program; Prescription Drugs” CMS-2238-FC on July 17, 2007.
